You are a participant of the International Photo Contest "Light and Colour" (hereinafter – «Participant» and «Contest»), which is held within the framework of a Festival under the same title (hereinafter - Festival) organized by the Interregional Social Charity Foundation «Quality of Life» (hereinafter - Organizer).
If you upload your photographs to the Contest web-site https://www.svet-tsvet.ru (hereinafter – Contest web-site) you accept and agree to the terms and conditions stipulated below.
Accepting the terms of the current Agreement you confirm and guarantee that:
- You or the person whose interests you represent (e.g. a minor – author of the photographs) hold exclusive legal rights with regards to the photographs submitted for the Contest;
- The photographs submitted for the Contest do not violate the laws of the Russian Federation, do not contain disparaging information, or any other information that goes against the moral principles or generally accepted values;
- If photographs contain third party (model) images, you have a written permission from models on publication and further use of the photographs, or the photographs meet the requirements of photo shooting in public places as per points 1,2,3, article 152.1 of the RF Civil Code;
- If any claims are made against the Organizer on the part of authorship or related rights owners, their authorized representatives or other third parties with regards to the use of photographs, the Participant undertakes to settle all such third party claims at his/her own expense;
- The legal representative of an underage participant (photograph author) of the Contest guarantees that he/she is really authorized by law to represent the interests of a minor who is the author of the photographs submitted for the Contest.
By taking part in the Contest the Participant grants the Organizer the free right to use the photographs within the framework of the Festival in ways defined by the civil laws of the Russian Federation, including:
- Publishing the photos on the Festival official web-site https://www.svet-tsvet.ru for public access;
- Using the photographs for marketing, advertising and promotional activities of the Contest and Festival, including publication in mass media and social networks;
- Using the photographs in exhibition and printed materials of the Contest and Festival (album, exhibition finalist catalogue, billboards, posters, programme, brochure and other printed materials of the Festival);
The Organizer undertakes to:
- Mention the author of the photograph, every time the images are used within the framework of the Festival and Contest;
- Not use the photographs in any materials denigrating honour and dignity of the author;
- Use the photographs only within the framework of the Festival and Contest (during the whole duration of the Festival and Contest).
The Author retains the right for the independent use of the photographs at his/her own choice and grant non-exclusive rights to their use to third parties. If an exclusive right to the images is granted to any third parties, the author must immediately notify the Contest and Festival Organizers to that effect.
This Agreement comes in force from the date the photographs are uploaded to the Contest web-site.
This Agreement can be dissolved upon mutual consent of the parties or in cases stipulated by the civil laws of the Russian Federation.
If any disputes arise, the parties will take all reasonable steps to solve them by way of two-party negotiations.
All the issues, not regulated by this Agreement, shall be regulated by the laws of the Russian Federation and additional agreements.
